Terms of Service

These Terms of Service ("Terms") govern your use of the Four States Land Scout website, weekly reports, emails, and data (together, the "Service"), operated by [LEGAL BUSINESS NAME] ("we," "us"). By using the Service or subscribing, you agree to these Terms.

1. What the Service is

The Service compiles information about real property (such as tax-delinquent parcels and foreclosure or court-sale notices) from public government records and presents it for people who want to acquire real property. The Service is information only. We do not buy, sell, or broker property, and we are not affiliated with or acting for any seller or government agency. Seller contact details and bid links in subscriber reports are the selling office's own published public information. We don't give legal, tax, title, or investment advice.

2. Permitted use: property acquisition only

You may use the Service only to identify, research, and evaluate real property you might buy, bid on, or make an offer on, and for related lawful business purposes.

3. Not a consumer report; prohibited uses

The Service is not a "consumer report", and we are not a "consumer reporting agency," as those terms are defined in the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) ("FCRA"). You agree that you will not use the Service or any information from it, in whole or in part, as a factor in determining anyone's eligibility for:

• credit or insurance;
• employment, promotion, reassignment, or retention;
• renting or leasing housing, including tenant screening;
• any license or government benefit; or
• any other purpose covered by the FCRA or similar state laws.

You also agree not to use the Service to harass, stalk, threaten, or discriminate against anyone. You may not use it for any purpose that violates applicable law, including fair-housing laws. By subscribing, you certify that you will use the Service only for the permitted purpose above. We may suspend or end access for any suspected prohibited use.

4. Verify before acting

Public records can be incomplete, out of date, or wrong. Properties can be redeemed, sold, withdrawn, cancelled, postponed, or re-priced at any time, often without notice to us. Before you bid, buy, or make an offer, you are responsible for checking every detail with the official source. That includes doing your own title search and due diligence, inspecting the property, and confirming the sale terms and applicable law. Tax-sale and foreclosure purchases can carry risks such as liens, environmental problems, access issues, and limited or no warranties of title.

5. Respectful and lawful outreach

If you contact property owners or other people you identify through the Service, you are solely responsible for following all applicable laws. These include the Telephone Consumer Protection Act (TCPA) and FCC rules, the National Do Not Call Registry and the Telemarketing Sales Rule, state do-not-call and telemarketing laws, the CAN-SPAM Act, and state foreclosure-rescue, home-solicitation, and consumer-protection laws. You must not use autodialers, prerecorded or artificial voices, or text blasts without the legally required prior express written consent. We do not provide phone numbers or email addresses. Owners may be facing hardship or grief, so please be respectful, honest, and non-coercive, and honor every request to stop contact. We may cancel the access of anyone who violates this section.

6. Subscriptions, billing, and cancellation

• Plans. Free (weekly email with sample leads), Local ($49 per month or $490 per year), and Pro ($99 per month). Prices and features are shown on our pricing page and may change with at least 30 days' notice to existing subscribers.
• Payment. Paid plans are billed in advance through our payment processor (Stripe) and renew automatically each month or year until you cancel. You authorize recurring charges to your payment method.
• Cancellation. You may cancel any time through your billing portal link or by emailing [SUPPORT EMAIL]. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds. [Choose a policy, e.g. "Payments are non-refundable except where required by law" or "Full refund within 7 days of first purchase."]
• Taxes. Prices do not include applicable taxes unless stated.

7. Your account and license

Your subscription is for you (or your business) and may not be shared, resold, redistributed, or published. That includes posting lists or records from the Service publicly or in other databases. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for the permitted purpose. You may not scrape, bulk-download, or reverse-engineer the Service.

8. No warranty

THE SERVICE AND ALL INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PROPERTY'S AVAILABILITY, CONDITION, TITLE, VALUE, OR INVESTMENT RESULT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOSSES FROM ANY PROPERTY TRANSACTION. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM.

10. Indemnity

You agree to defend and indemnify us against claims arising from your use of the Service. That includes your outreach to any person and any violation of these Terms or the law.

11. Removal requests

Property owners or their families may ask us to review or remove a listing by emailing [SUPPORT EMAIL]. We will respond promptly.

12. Governing law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [COUNTY] County, Arkansas, and you consent to their jurisdiction. [Attorney: consider arbitration/class-waiver clause.]

13. Changes
